Odyssey Pride, LLC – Guest Reservation Terms and Conditions

IMPORTANT NOTICE TO GUESTS
BY COMPLETING A RESERVATION AND REMITTING PAYMENT FOR A CRUISE OR VACATION THROUGH ODYSSEY PRIDE, LLC (“Odyssey Pride”), YOU (“Guest”) EXPRESSLY AGREE TO BE LEGALLY BOUND BY THE FOLLOWING GUEST RESERVATION TERMS AND CONDITIONS (THE “Agreement”), ON BEHALF OF YOURSELF AND ALL OTHER INDIVIDUALS INCLUDED IN YOUR RESERVATION.
THIS AGREEMENT CONTAINS IMPORTANT PROVISIONS INCLUDING, BUT NOT LIMITED TO:

1. Guest Admission and Participation Rights Policy
1.1 Reservation of Rights
Odyssey Pride reserves the absolute right, in its sole and exclusive discretion, to deny, refuse, or revoke admission, participation, or reservation to any individual or group at any time, with or without reason, and without any obligation to provide notice or explanation.
1.2 No Obligation to Provide Notice or Reason
Odyssey Pride shall not be required to provide written or verbal notice, reasoning, or justification for its decision to deny or revoke participation.
1.3 Non-Discrimination Assurance
This policy is enforced in accordance with applicable federal, state, and local anti-discrimination laws.
1.4 Limitation of Liability
Odyssey Pride shall not be liable for any loss, cost, or damages arising from denied participation. Refunds, if any, will be issued at Odyssey Pride’s discretion per applicable policies.
2. Third-Party Travel Suppliers; Limitations of Liability
Odyssey Pride acts solely as a charterer and event coordinator. All travel, accommodation, and related services (“Services”) are provided by third-party suppliers (“Suppliers”), who retain full operational control. Odyssey Pride disclaims any liability for acts or omissions of any Supplier.
You agree that any claim arising from acts of God, terrorism, mechanical failure, weather, labor strikes, or other force majeure events must be directed to the relevant Supplier.
All Supplier-issued contracts, policies, and travel terms are incorporated herein by reference and apply to your booking.
3. Guest Responsibilities; Travel Documentation
Guests are solely responsible for obtaining and presenting valid travel documents including passports, visas, and health certificates. Failure to present valid documentation will result in denied boarding and forfeiture of all payments.
4. ADA Accessibility and Special Needs
Odyssey Pride complies with the Americans with Disabilities Act (ADA). Guests requiring accommodations must submit the Guest Special Needs Form no later than 60 days before departure.
Odyssey Pride will coordinate requests with Suppliers but cannot guarantee fulfillment, especially in destinations where ADA compliance is not mandatory. Service animals are subject to Supplier policies.

5. Payment Terms
Guests may choose from the following payment options:

Standard Plan: 25% deposit at booking, 25% due at 180 days, balance at 90 days prior.

Monthly Plan: $200 non-refundable deposit, monthly auto-payments, final payment due 60 days prior.

Pay in Full: Full payment at booking (required for specific categories and promos).
Payments must be made via approved credit card unless otherwise arranged. A 5% fee applies to changes in payment method. Missed payments may result in cancellation without refund.
6. Cancellations, Changes, and Force Majeure
Odyssey Pride reserves the right to cancel, delay, or modify the cruise or itinerary due to force majeure or operational constraints.
Stateroom changes may occur due to operational needs. Changes that do not affect embarkation are not considered material.
Refunds or credits will be issued per the applicable cancellation policy. Monthly Plan deposits are non-refundable and non-transferable.
7. Guest Conduct and Right to Refuse Service
Guests may be denied participation or removed without refund for:

Illegal activity or drug possession

Noncompliance with identification or screening
-
Disruption or unsafe behavior

Violation of Supplier or Odyssey Pride rules
Odyssey Pride enforces a strict zero-tolerance policy for illegal drugs.
8. Anti-Pornographic Content and Conduct Policy
8.1 Prohibited Conduct
The creation, filming, recording, or distribution of pornographic or sexually explicit content on Odyssey Pride vessels, properties, or affiliated locations is strictly prohibited.
This includes activities for commercial or non-commercial purposes, including content distributed via platforms such as OnlyFans, Fansly, or similar.
8.2 Enforcement and Legal Action
Violators may be:

Immediately removed at their own expense

Permanently banned from future events
-
Subject to legal action and/or criminal referral
This applies to guests and third-party content creators.
8.3 No Tolerance Policy
Odyssey Pride maintains a zero-tolerance stance on this matter. Participation in such activities will result in immediate enforcement actions.
8.4 Acknowledgment
By attending any event, guests agree to comply with this policy.
9. Damage Liability
Guests are responsible for any damage caused to the vessel, facilities, or other guests by their actions. Guests agree to indemnify Odyssey Pride and its Suppliers for all resulting damages, fines, and legal expenses.
10. Service Fees
The following fees apply:

Returned payments: $50

Wire transfer receipt: $25

Manual monthly billing: $50
-
Name change: $250 ($150 before April 27, 2024)

Payment method change: 5% of total paid
11. Travel Insurance
Odyssey Pride recommends the purchase of travel and cancellation insurance from third-party providers. Odyssey Pride is not liable for coverage issues or claims related to such policies.
12. Publicity Release
By participating in any Odyssey Pride event, you grant Odyssey Pride a worldwide, perpetual, royalty-free right to use your name, image, voice, and likeness for promotional purposes in any medium.
You waive all moral rights and agree not to make claims against Odyssey Pride for the use of such media. You may rescind this release in writing prior to or during the trip. No opt-outs are accepted post-event.
13. Dispute Resolution; Arbitration Agreement and Class Action Waiver
13.1 Arbitration Requirement
All disputes must be resolved through binding arbitration in Los Angeles County, CA, administered by the American Arbitration Association.
13.2 Notice and Time Limit

Written notice must be submitted within six (6) months of the incident.

Arbitration or lawsuit must be filed within one (1) year and served within 120 days.
13.3 Class Action Waiver
You agree to pursue claims individually and waive all rights to class actions or class arbitration. This clause is not severable.
14. Choice of Law and Venue
This Agreement is governed by the laws of the State of California. Venue for any action or proceeding shall lie exclusively in Los Angeles County, California.
15. Attorney’s Fees
In any arbitration or legal action, the prevailing party shall be entitled to recover reasonable attorneys’ fees and legal costs.
16. Entire Agreement and Assignment
This Agreement constitutes the entire agreement between the guest and Odyssey Pride. Odyssey Pride may assign its rights and obligations hereunder without notice.
